Clients responsibilities & liabilities as per the OH&S Act.
- You shall make provision for the cost of Health and Safety at pre-tender stage of the project.
- You shall provide the contractor with an Occupational Health and Safety Specification for that site as well as any relevant information at pre-tender stage.
- You shall ensure that the principle contractor provides you with an Occupational Health and Safety Plan. This Plan needs to be implemented and maintained.
- You shall do regular inspections on the principle contractor ensuring that he complies with the safety plan he provided you with.
- The client will be held liable for any accidents or incidents occurring on the site.
- The Client shall appoint Principal Contractors (PC’s) in writing.
- The Client shall stop the work of any contractor which is not in accordance with the PC’s H&S Plan.
- The Client shall ensure that where changes are made sufficient H&S information & resources are made available to the PC to execute the work safely.
- The Client shall ensure that PCs are in good standing with a Compensation Insurer prior to work commencing.
- The Client shall ensure that contractors submitting tenders have made provision for the cost of H&S measures.
- The Client shall discuss & negotiate with the PC re. the contents of the H&S plan and approve it for implementation.
- The Client shall ensure that a copy of the PC’s H&S plan is available to an employee, inspector or contractor.
- The Client shall NOT appoint a PC unless he/she are satisfied that the PC has the necessary competencies & resources to work safely.
- The Client may appoint an Agent in writing to act as his/her representative but must ensure that the agent is competent and has the necessary resources available to perform his/her duties. Where such an appointment is made, the responsibilities as for the client, shall apply to the agent so appointed.
